Antes de utilizar nuestros servicios, le pedimos que lea detenidamente estos Términos y Condiciones, que establecen las reglas aplicables a los servicios que ofrecemos ("Servicios") a través de nuestro sitio web https://www.flecto.io ("Sitio web") y nuestra aplicación móvil ("Aplicación móvil") (colectivamente la "Plataforma"), y que constituyen un acuerdo legalmente vinculante entre todos los que utilizan la plataforma Flecto.

Estos Términos y Condiciones son complementados en todo lo no previsto aquí por las condiciones concretas para cada artículo que los Usuarios introduzcan en la Plataforma, así como por nuestra Política de Privacidad y Política de Cookies, que puede consultar en https://flecto.io/legal/privacy-policy, y que debe aceptar expresamente al registrarse en Flecto.

Al aceptar este acuerdo, el Cliente también acepta los términos y condiciones de Omocom, socio de Flecto en los seguros proporcionados. Los términos y condiciones entre Omocom y Flecto estarán disponibles en todos los alquileres registrados con el servicio adicional de seguro.

Cuando nos referimos a "nosotros", "nuestro" o "Flecto", nos referimos a Rnters, S.A. Cuando decimos "usted" o "su", nos referimos a la persona que utiliza los Servicios a través de nuestra Plataforma.

DEFINICIONES

A menos que del contexto se desprenda otro significado, siempre que en este documento se utilicen los términos y expresiones en mayúsculas enumerados a continuación, ya sea en singular o en plural, tendrán el siguiente significado:

• Artículo: cualquier bien o producto disponible para alquilar a través de la Plataforma Flecto Market;
• Contrato de Alquiler: el contrato de alquiler celebrado entre Usuarios, compuesto por estos Términos y las condiciones específicas definidas y presentadas por el OWNER en la Plataforma asociadas al Artículo en particular, presentadas en su perfil de usuario o cualquier condición inherente al alquiler que no se presente en la Plataforma;
• Cliente: Usuario del Flecto SaaS o software, con condiciones especiales detalladas en el Punto 20;
• Derechos de Propiedad Intelectual: todos los derechos de propiedad intelectual, patentables o no, incluidos derechos sobre algoritmos, código binario, marcas, modelos de negocio, software, secretos comerciales, logotipos, patentes, datos de clientes, entre otros;
• RENTER: Usuario que es una persona física o jurídica y alquila artículos a través de Flecto Market proporcionados por otros Usuarios de la Plataforma;
• OWNER: una persona física o jurídica que utiliza nuestro software para gestionar sus operaciones de alquiler y puede también ofrecer bienes para ser alquilados;
• Marketplace: el sitio web gestionado por Flecto, disponible en https://market.flecto.io/;
• Registro: proceso de creación de una Cuenta por el Usuario, que incluye la aceptación de estos Términos y Condiciones y de la Política de Privacidad de Flecto;
• Usuario: persona física o jurídica con capacidad legal plena para alquilar o proporcionar artículos listados en la Plataforma Flecto Market, de acuerdo con la ley portuguesa.

ACEPTACIÓN DE LOS TÉRMINOS Y CONDICIONES

Al finalizar su proceso de registro en Flecto, usted declara que ha leído, comprendido y acepta nuestros Términos y Condiciones para el uso de la Plataforma. La utilización de la Plataforma está condicionada a la aceptación de estos Términos. Si no está de acuerdo, no debe completar el registro.

CONTRATOS DE ALQUILER CELEBRADOS ENTRE USUARIOS

Flecto facilita la Plataforma para que los OWNER ofrezcan artículos en alquiler y los RENTER puedan contactar con ellos para alquilar dichos bienes. Flecto no es parte del contrato celebrado entre los Usuarios. Los Usuarios son responsables de todas las obligaciones derivadas del contrato de alquiler.

UTILIZACIÓN DE LOS SERVICIOS DE FLECTO

Para utilizar la Plataforma, deberá registrarse y crear una cuenta. Debe tener al menos 16 años para registrarse como OWNER o RENTER. Durante el proceso de registro, se le pedirá que proporcione información personal, incluyendo su nombre y correo electrónico, y cree una contraseña.

OBLIGACIONES DEL RENTER

El RENTER debe proporcionar información precisa, no permitir que terceros usen su cuenta, pagar el precio del alquiler y devolver los artículos en las mismas condiciones en que fueron entregados.

PAGOS

El servicio debe ser pagado al momento de la reserva. Si el OWNER rechaza la reserva, el dinero será reembolsado automáticamente.

Welcome to Flecto

Before using our services, we ask that you carefully read these Terms and Conditions, which establish the rules that apply to the services we provide ("Services") through our website https://www.flecto.io ("Website") and our mobile application ("Mobile App") (collectively the "Platform"), and which constitute a legally binding agreement between all those who use the Flecto platform.

These Terms and Conditions are supplemented in all matters not addressed here by the specific conditions related to each item introduced by Users on the Platform, as well as by our Privacy Policy and our Cookie Policy, which can be accessed at https://flecto.io/legal/privacy-policy, and which you must expressly accept when registering on Flecto.

By accepting this agreement, the Client acknowledges that they are also accepting the terms and conditions of Omocom, Flecto's partner in providing insurance. The terms and conditions between Omocom and Flecto will be made available for all rentals registered with the additional insurance service.

When we refer to "we", "our", or "Flecto", we refer to Rnters, S.A. When we say "you" or "your", we refer to the person using the Services through our Platform.

DEFINITIONS

Unless the context indicates otherwise, the following capitalized terms, whether used in singular or plural, will have the following meanings:

• Item: any good or product available for rent through the Flecto Market Platform;
• Rental Agreement: the rental agreement between Users, consisting of these Terms and the specific conditions defined and presented by the OWNER on the Platform, associated with the particular Item, presented in their user profile, or any conditions not presented on the Platform;
• Client: User of Flecto SaaS or software, with special conditions detailed in Point 20;
• Intellectual Property Rights: all intellectual property rights, whether patentable or not, including rights in algorithms, binary code, trademarks, business models, software, trade secrets, logos, patents, customer data, among others;
• RENTER: User who is an individual or company and rents items through Flecto Market provided by other Users of the Platform;
• OWNER: a person or company that uses our software to manage their rental operations and may also offer goods for rent;
• Marketplace: the website managed by Flecto, available at https://market.flecto.io/;
• Registration: the process of creating a User Account, including the acceptance of these Terms and Conditions and Flecto's Privacy Policy;
• User: an individual or company with full legal capacity to rent or provide items listed on the Flecto Market Platform in accordance with Portuguese law.

ACCEPTANCE OF THE TERMS AND CONDITIONS

By completing your registration on Flecto, you declare that you have read, understood, and accepted our Terms and Conditions for using the Platform. The use of the Platform is conditional on the full acceptance of these Terms. If you do not agree, you should not complete the registration.

RENTAL AGREEMENTS BETWEEN USERS

Flecto provides the Platform for OWNERS to offer items for rent, and RENTERS can contact them to rent these goods. Flecto is not a party to the contract between the Users. The Users are responsible for all obligations arising from the rental agreement.

USE OF FLECTO SERVICES

To use the Platform, you must register and create an account. You must be at least 16 years old to register as an OWNER or RENTER. During registration, you will be asked to provide personal information, including your name and email, and create a password.

RENTER'S OBLIGATIONS

The RENTER must provide accurate information, not allow third parties to use their account, pay the rental price, and return the items in the same condition as they were delivered.

PAYMENTS

The service must be paid at the time of booking. If the OWNER rejects the booking, the money will be automatically refunded.
